Mediation & Negotiation
Most disputes end in a settlement. The question is how much time and money is spent before getting there. Mediation brings that moment forward. Our principal is an accredited mediator, and we act both as advocates in mediation and as neutrals.
Mediation before and during a case
We represent clients in mediation and structured negotiation across commercial, property, family and employment disputes, and we act as mediator where the parties want a neutral. Mediation can be private, before any case is filed, or court-connected once proceedings are on foot.
Court-connected mediation
Bangladeshi procedure builds mediation into litigation. Section 89A of the Code of Civil Procedure 1908 allows civil suits to be referred to mediation, the Artha Rin Adalat Ain 2003 provides for settlement in loan recovery, and the Family Courts Act 2023 encourages settlement at more than one stage. A case already in court can still be resolved this way.
Private mediation
Where no case has been filed, private mediation is faster still and keeps the dispute out of the public record. It works particularly well where the parties have a relationship worth preserving: business partners, co-owners, family members, employer and employee.
What mediation is not
Mediation is not a soft option or a sign of weakness, and it is not appropriate where there is real coercion, violence, or a need for a public ruling. We say so when that is the case rather than pushing every dispute toward settlement.
What helps
- A short statement of the dispute and what you want
- The key documents and figures
- Your realistic best and worst outcomes if it were litigated
- Any offer already made or received
Where it happens, and how long it takes
Private mediation can be arranged within days and often concludes in one or a few sessions. Court-connected mediation happens within the proceedings, at the stage the relevant statute provides. Either way it is measured in weeks rather than the years a contested case can take.
Assess suitability
We check whether mediation is right and safe for your dispute, and say so if it is not.
Prepare the position
We work out your numbers, your priorities and your walk-away point.
Mediate
We represent you in the session, or act as the neutral where appointed.
Record the outcome
We put any agreement into a form that binds and can be enforced.

Most of what clients ask at a first meeting is answered step by step in our free guides. Read the ones below first; book a consultation when you want the chamber to act.
Common questions
Does agreeing to mediate make me look weak?
No. Commercial parties mediate routinely, and the courts here actively encourage it. What weakens a position is being unprepared, not being willing to talk.
What if mediation fails?
The case continues, and what was said in the mediation is not used against you. Even a failed mediation usually narrows the issues and speeds up what follows.
Can a case already in court be mediated?
Yes. Bangladeshi procedure provides for it, including under section 89A of the Code of Civil Procedure and in family and loan recovery matters. Filing a case does not close the door.
Which disputes need mediation before a case is filed?
Under the Legal Aid Services Act 2000 as amended in 2025–26, scheduled disputes must first go to the District Legal Aid Office in districts where the scheme is in force: family matters under the Family Courts Act 2023, dowry-demand cases (Dowry Prohibition Act 2018, ss.3–4), house-rent disputes, pre-emption and parents’ maintenance. Mediation is free and time-limited.
How do I apply for legal aid?
Apply to the District Legal Aid Officer at the district judge court, or call the national legal aid helpline 16699. People who qualify get a lawyer free of charge, and mediation at the legal aid office is free for everyone.
Settle it sooner
