Common questions
Is an arbitration award binding?
Yes. Under the Arbitration Act 2001 an award can be challenged only on limited grounds, within the time the Act allows. If it is not set aside, it can be enforced in court as if it were a decree.
Is mediation now compulsory before filing a case?
For certain family and civil disputes, the Legal Aid Services Act 2000 as amended in 2025 requires pre-case mediation through the district legal aid office in districts where it has been rolled out. Courts can also send pending civil suits to mediation under section 89A of the Code of Civil Procedure.
Is a village salish decision legally valid?
An informal salish is not a court decree. It binds only if the parties sign an enforceable settlement or arbitration agreement, or if it is a decision of a Village Court under the Village Courts Act 2006 within that court's limits.
Can a criminal case be settled?
Only compoundable offences under section 345 of the Code of Criminal Procedure can be compromised, some with the court's permission. Serious offences cannot be settled even if the complainant agrees.
Is mediation cheaper than going to court?
Usually yes. Legal aid mediation is free for eligible people, and a private mediation or negotiation costs far less than a full suit. If mediation fails, you can still go to court.
