Common questions
How do I recover money someone owes me?
Start with a written legal demand notice that states the amount and a deadline. If that fails, you can file a money suit in the civil court, or a case under section 138 of the Negotiable Instruments Act if a cheque was given and bounced. The right route depends on the papers you hold.
What are the deadlines in a cheque dishonour case?
Present the cheque within six months of its date. After dishonour, send written notice to the drawer within 30 days of learning of it. The drawer then has 30 days to pay. If they do not, file the complaint within one month after those 30 days end. Missing a step can end the case.
How long do I have to file a money suit?
Most money claims must be filed within three years under the Limitation Act 1908, counted from when the money became due. Some claims have shorter or longer periods, so check the date early.
Do I need to send a notice before suing the government?
Yes. Section 80 of the Code of Civil Procedure requires two months' written notice before a suit against the government or a public officer for an official act, with limited exceptions for urgent relief.
What does a civil suit cost?
The court fee depends on the value of the claim under the Court-fees Act 1870, plus lawyer's fees and process costs. We give you the court fee estimate and our fee basis in writing before filing.
