Common questions
What is the difference between an advocate and a barrister?
A barrister has been called to the Bar in England and Wales. To appear in Bangladeshi courts, a barrister must also enrol with the Bangladesh Bar Council as an advocate, like every other lawyer here. Barrister Mohammad Rasel is both.
How quickly can you move for bail?
We start work the day you call. Whether bail can be moved that day depends on the court sitting, the section charged and whether the case papers are available. For anticipatory bail, the petition goes to the High Court Division.
Which court will my case go to?
Criminal cases start before a Magistrate, and serious ones go to the Sessions Court or a special tribunal. Civil suits go to the Assistant Judge or Joint District Judge depending on value. Writs go to the High Court Division.
Can a criminal case be compromised?
Only offences the law lists as compoundable can be settled by compromise. Others cannot be withdrawn by agreement, though a settlement can still matter for bail and sentence. Our guide lists which offences are compoundable.
What does a writ in the High Court cost?
The court fee is small. Most of the cost is the drafting and the hearings, which depend on how contested the matter is. We give you the fee basis in writing before filing.
