Anticipatory Bail in Bangladesh: Who Gets It, How, and What Happens Next

Anticipatory bail protects you from arrest before you are taken into custody. It is an exception, not a routine order, so the application has to be right first time.

  • Anticipatory bail is granted under section 498 CrPC, mostly by the High Court Division.
  • You must appear in person before the bench; it is not granted in your absence.
  • It usually lasts a fixed period, after which you surrender to the lower court and ask for regular bail.
  • Courts grant it where the case looks like harassment, and rarely in murder, rape or violent cases.

The short answer

Anticipatory bail is an order that you be released on bail if arrested in a named case. In Bangladesh it comes from section 498 of the Code of Criminal Procedure. The Appellate Division has called it an extraordinary remedy: the court must see special circumstances, such as a case filed to harass or humiliate you.

In practice you apply to the High Court Division with a lawyer, appear in person on the day of hearing, and if granted you get protection for a fixed time. Before it ends, you surrender to the court where the case is pending and ask for regular bail.

Who can get anticipatory bail

  • Good grounds: a case that looks motivated, a civil or family dispute dressed up as a crime, delay in filing the FIR, weak or vague allegations, a clean record and fixed address.
  • Hard cases: murder, rape, serious violence, drugs and cases where evidence or witnesses could be affected.
  • You must not be in custody and should not be avoiding an arrest warrant already being executed.

How the High Court process works

  1. Collect papers: certified or photocopy of the FIR or complaint, the case number and police station, any GD or prior orders, your NID and proof of address.
  2. Petition: your lawyer drafts the petition with an affidavit and files it in the High Court Division bench that hears bail matters.
  3. Listing and hearing: when the matter is in the cause list you must be physically present in court.
  4. Order: if granted, the bench usually gives protection for a set number of weeks and directs you to surrender before the lower court within that time.

Cost and time

There is no government fee beyond small court fees and certified copy charges. The main cost is the advocate’s fee, which depends on the case and the bench. Time from filing to hearing varies with the cause list, from days to a few weeks; urgent matters can be mentioned for early hearing.

After the protection ends

Surrender before the court named in the order, normally the Magistrate or Sessions court, before the deadline, and apply for regular bail there. The lower court decides on its own, so prepare the same documents. Missing the deadline exposes you to arrest.

Common questions

How do I get anticipatory bail?

Your lawyer files a petition under section 498 CrPC in the High Court Division with the FIR copy. You must appear in person at the hearing. If granted, you get protection for a fixed period and then surrender to the lower court.

How much does anticipatory bail cost?

Court fees and certified copies are small. The main cost is the advocate's fee, which depends on the case. We quote after seeing the FIR.

How long does anticipatory bail last?

It is usually granted for a fixed number of weeks or until a stage of the case, as the order says. Before it ends you must surrender to the lower court and ask for regular bail.

Can the Sessions Judge give anticipatory bail?

Section 498 gives the power to the High Court Division and the Court of Session, but in Bangladesh pre-arrest bail is sought mainly in the High Court Division. The Sessions Judge decides bail when you surrender.

Can I get anticipatory bail without going to court?

No. Courts require the accused to appear in person when the petition is heard.

In which cases is anticipatory bail refused?

Courts rarely grant it in murder, rape, serious violence or drug cases, or where evidence and witnesses could be affected.

What happens if I miss the surrender date?

The protection ends and you can be arrested. Surrender in time, or ask your lawyer to apply for an extension before the date passes.

I live abroad. Can I get anticipatory bail before I land?

You must be present in court, so you need to be in Bangladesh for the hearing. Talk to a lawyer before travelling about the risk of arrest at the airport.
