False Case Filed Against You in Bangladesh? Anticipatory Bail, Quashing & Compensation
A false case is meant to frighten you into paying, leaving your land or dropping a claim. The complainant is counting on panic. The law gives an accused several distinct tools, and using the right one at the right stage is what ends these cases. Doing nothing, or hiding, is what makes them worse.
- Get the case papers before you do anything else
- Seek anticipatory bail before arrest where you can
- The High Court Division can quash an abusive case
- A Magistrate can order compensation (up to Tk 50,000) against a false complainant
In this guide: The first 48 hours · Anticipatory bail · During the investigation · Discharge and quashing · Making the complainant answer for it · The false cases I see most often
The short answer
Get the case documents, secure bail before arrest if possible, and preserve your evidence. Then use the remedy that fits the stage: a final report or interim discharge during investigation, discharge at the charge hearing, quashing by the High Court Division under section 561A of the Code of Criminal Procedure, or acquittal at trial. Once the case fails, the complainant can be made to pay compensation and can be prosecuted.
The first 48 hours
- Find out exactly what was filed. A police case (FIR) or a complaint petition in court? Which sections, which station or court, and the case number? An advocate can get certified copies.
- Do not hide and do not contact the complainant. Absconding leads to warrants and attachment of property. Contact, even to “talk it out”, often leads to a second case for threats.
- Preserve evidence now. CCTV is usually overwritten within days. Collect location data, travel and office records, messages, call logs and the names of witnesses.
- Do not pay anyone to settle a non-compoundable case informally. It does not end the case and can be used against you.
Anticipatory bail
If you have not been arrested, you can apply for bail before arrest under section 498 of the Code of Criminal Procedure, in practice mostly in the High Court Division. The High Court Division usually grants it for a set period, often a few weeks, and directs you to surrender before the lower court within that time, where you then seek regular bail. Apply early, disclose everything accurately, and do not miss the surrender date. If you live abroad, plan the return around that date so you are not arrested at the airport first.
During the investigation
Under the 2026 amendments, section 173B sets 60 working days from receipt of the information to complete the investigation, and the investigating officer can ask the Magistrate for more time, giving reasons. It is not an automatic dismissal rule. Give the investigating officer your evidence in writing with a covering letter and keep a received copy. If the evidence does not support the accusation, the officer should submit a final report. Section 173A now also allows the court, on an interim report showing no evidence against you, to discharge you before the investigation ends.
Discharge and quashing
Discharge at the charge hearing
When the charge sheet reaches court, argue at the charge hearing that the allegations, even if accepted, disclose no offence. The Magistrate (section 241A) or the Sessions Judge (section 265C) can discharge you.
Quashing under section 561A
The High Court Division can quash a proceeding that is an abuse of the process of the court: where the allegations disclose no offence, where a civil dispute has been dressed up as a crime, or where the case is barred by law. A successful quashing ends the case entirely. It is not a way to argue disputed facts; those are for trial.
Making the complainant answer for it
- Compensation under section 250. In a Magistrate-triable case that ends in discharge or acquittal, if the Magistrate finds the accusation false and either frivolous or vexatious, gives the complainant or informant a chance to show cause, and records reasons, compensation must be ordered. The Magistrate fixes the amount, up to Tk 50,000 (Tk 25,000 for a third-class Magistrate). A final report alone does not entitle you to it.
- False charge under section 211 of the Penal Code. Up to two years’ imprisonment, or up to seven years where the false charge was of a serious offence. Where the false charge was made in court, prosecution generally needs a complaint by that court.
- False case under section 17 of the Women and Children Repression Prevention Act. Up to seven years’ rigorous imprisonment and a fine.
- Malicious prosecution. A civil suit for damages once you are acquitted or discharged.
The false cases I see most often
Dowry and women and children repression cases arising from a marital breakdown; cheque cases built on “security” cheques; land disputes turned into assault or theft cases; and cyber complaints filed to silence someone. Each has its own defences and timing. In the marital cases in particular, early anticipatory bail and a clear record of the real history of the dispute make the most difference.

Common questions
What should I do if a false case is filed against me?
Get the case details, instruct an advocate, apply for anticipatory bail if not arrested, preserve your evidence and do not contact the complainant.
What is the punishment for filing a false case?
Under Penal Code section 211, up to two years, or up to seven years for a false charge of a serious offence. A false case under the Women and Children Repression Prevention Act carries up to seven years’ rigorous imprisonment.
How do I get anticipatory bail?
By an application under section 498, usually in the High Court Division. It protects you for a period within which you must surrender before the lower court and seek regular bail.
Can the High Court quash a false case?
Yes, under section 561A, where the case is an abuse of process, for example where no offence is disclosed or a civil dispute has been turned into a criminal case.
Can I get compensation for a false case?
Yes, on conditions. If the case ends in discharge or acquittal and the Magistrate, after hearing the complainant, finds it false and frivolous or vexatious, section 250 requires compensation, up to a maximum of Tk 50,000. You can also sue for malicious prosecution after acquittal or discharge.
What should I do in a false dowry or repression case?
Seek anticipatory bail promptly, gather evidence of the real history of the marriage, and consider a case under section 17 of the Act once the case fails.
Can a false case be settled by compromise?
Only compoundable offences can be compromised, some only with the court’s permission. Paying someone informally does not end a non-compoundable case.
How long does it take to get out of a false case?
Anticipatory bail can be sought within days. Ending the case by final report, discharge or quashing usually takes months; a full trial takes longer.
I live abroad and a case was filed. Can I be arrested when I land?
If there is a warrant, yes. Have an advocate check the case and arrange anticipatory bail or a surrender plan before you travel.
What should I do about a false case under section 107?
Section 107 CrPC proceedings are preventive. They are heard by an Executive Magistrate and lead at most to a bond to keep the peace for up to one year; they are not a conviction. Appear through a lawyer, show there is no threat to the peace, and ask to be discharged.
