The Environmental Clearance Certificate: Categories, Location Clearance, Documents, Validity and Penalties under the Environment Conservation Rules 2023
Section 12 of the Environment Conservation Act 1995 forbids establishing or operating any industrial unit or project without an environmental clearance certificate from the Department of Environment, and s.15 punishes the breach with two to five years' imprisonment, a fine of Tk 1 lakh to Tk 5 lakh, or both. The Environment Conservation Rules 2023 (SRO 53-Law/2023, 5 March 2023) replaced the 1997 Rules and sorted every activity into four colours: Green, Yellow, Orange and Red. Green projects apply for the certificate directly; Yellow, Orange and Red must first obtain a location clearance, before any construction and before gas, electricity or water are connected, and no unit starts trial production without the ECC. Validity is five years for Green, two for Yellow and one for Orange and Red. This guide sets out the categories, the two-stage sequence, the documents (including when an IEE or a full EIA is required), the fee basis, the timelines in the Rules and the consequences of operating without.
- Four categories under r.5: Green, Yellow, Orange, Red; the 1997 Orange-A and Orange-B split is gone, and the colour decides the paperwork, the timeline and the validity.
- Two stages for Yellow, Orange and Red (r.6): a location clearance certificate before construction or any utility connection, then the ECC before trial production; Green goes straight to the ECC; units in an EPZ, economic zone or BSCIC estate need the ECC only.
- Documents scale with the colour: project profile, land papers, local NOC, trade licence and challan for all; layout, process flow and waste plan from Yellow; an Initial Environmental Examination and ETP design for Orange; terms of reference and a full Environmental Impact Assessment by an enlisted consultant for Red.
- Validity under r.20: Green five years, Yellow two, Orange and Red one, renewal applied for at least thirty days before expiry; renewal fee one quarter of the fresh fee under the schedule as reported; 15% VAT on fees; appeal within thirty days (r.27).

The short answer
Find your colour first; everything else follows from it. Use the lookup below as a first guide, then confirm with the divisional DoE office, because Schedule 1 places the same product in different colours by capacity. Green (software, assembly, small food processing without a boiler): apply for the ECC on ecc.doe.gov.bd with the project profile, land deed or lease with khatian and mouza map, local authority no-objection, trade licence and TIN, and the treasury challan; an inspector visits; the certificate follows. Yellow (hotels, restaurants, garments without wet processing, printing): apply for the location clearance with the same papers plus the layout, process flow and waste management plan, and only after it is issued connect utilities and build; then apply for the ECC. Orange (pharmaceuticals, dyeing and washing, plastics, metal, cement grinding, real estate): the location clearance needs an Initial Environmental Examination and the ECC needs the ETP designed and, for wet processes, commissioned. Red (tanneries, chemicals, power, cement, paper, shipbreaking, zones and large infrastructure): terms of reference approved, a full Environmental Impact Assessment by a DoE-enlisted consultant, public consultation, then the ECC. The three mistakes we see are building before the location clearance, letting a one-year Orange certificate lapse, and expanding capacity without a fresh clearance (s.12(3)).
Category lookup: which colour is your project
The four categories and how a project is placed
| Category | Typical activities (Schedule 1, as reported) | Stages | Assessment | Validity (r.20) |
|---|---|---|---|---|
| Green | Software and IT, electronics assembly, small food processing, handloom, tailoring, small garments without washing or dyeing | ECC only | None beyond the application | 5 years |
| Yellow | Hotels and restaurants, garment cutting and sewing, printing and packaging, bakeries, bottled water, cold storage, clinics | Location clearance, then ECC | Layout, process flow, waste plan | 2 years |
| Orange | Pharmaceutical formulation, textile dyeing, washing and printing, plastics and rubber, steel re-rolling and plating, cement grinding, bricks, dairy and feed, real estate and commercial high-rise | Location clearance, then ECC | Initial Environmental Examination; ETP design | 1 year |
| Red | Tanneries, chemicals, fertiliser and pesticides, power plants and fuel, cement clinker, paper and pulp, sugar and distilleries, shipbreaking, batteries, economic zones and large infrastructure | Location clearance (with ToR), then ECC | Full Environmental Impact Assessment by an enlisted consultant; public consultation | 1 year |
Rule 5 makes the four colours; Schedule 1 lists the activities. Two cautions. First, capacity moves the colour: a feed mill or a printing press above a stated output climbs a class, and a project that is not in the Schedule at all is placed by the Director General. Second, a unit inside an export processing zone, an economic zone or a BSCIC industrial estate needs the ECC only, under the proviso to r.6(1), because the zone itself holds the location clearance; it still needs the ECC in its own colour before trial production. Older material still describes Orange-A and Orange-B and a three-year Green validity; those were the 1997 Rules and are wrong under the 2023 Rules.
Location clearance before anything is built
Rule 6 is the sequence the Act’s penalty hangs on. A Yellow, Orange or Red project applies first for the location clearance certificate, and r.6(3) forbids construction and any gas, electricity or water connection until it is issued; r.6(4) forbids trial production until the ECC is issued. The location clearance is where the DoE decides whether the site is acceptable at all: distance from residential areas, schools, wetlands and water bodies; the zoning in the city master plan; access and discharge routes. For Orange the application carries an Initial Environmental Examination; for Red the applicant first obtains approval of the terms of reference for the EIA, commissions the study from a consultant on the DoE’s enlisted panel, holds the public consultation the Rules require, and submits the EIA with the application. A location clearance is not a licence to operate; it is permission to build what the file describes, and material changes (a second line, a boiler, a different process) go back to the office. Green projects skip this stage, which is why so many factories argue for Green at the first meeting; the divisional office, not the applicant, fixes the colour.
Documents, portal and timelines
Applications go through the ECC portal (ecc.doe.gov.bd) to the divisional office, on the prescribed form with: the project profile or feasibility summary; land ownership documents (deed, khatian, mouza map, or lease); the no-objection certificate of the union parishad, pourashava or city corporation; the trade licence and TIN; the treasury challan for the fee and the VAT challan; and, from Yellow upward, the layout plan, process flow diagram and waste management plan; from Orange, the IEE and effluent treatment plant design; for Red, the approved terms of reference and the EIA. The timelines in the Rules, as reported by practitioners and not read by us in the gazette, are: Green ECC within seven working days of the inspection report (r.9); Yellow location clearance fifteen working days and ECC seven (rr.10–11); Orange location clearance twenty-one working days and ECC twenty (rr.12–13); Red location clearance sixty working days or more from the EIA and ECC thirty (r.19). Real elapsed time is longer than the sum, because the inspection is scheduled after the file is complete and the clock restarts on each query. An applicant refused or aggrieved by a condition appeals within thirty days on a Tk 5,000 fee (r.27), for decision within ninety working days (r.29).
Fees and renewal
The fee is set by category and by investment slab in the schedule to the Rules. We could not read the 2023 schedule at the date above; the last public figures are the 1997 schedule as amended, with twelve investment slabs running from Tk 1,500 for an investment of Tk 1 lakh to 5 lakh up to Tk 5,00,000 above Tk 1,000 crore, renewal at one quarter of the fresh fee, and 15% VAT deducted at source on issue and renewal since January 2016. Treat these as an order of magnitude and take the exact figure from the portal’s demand before paying the challan (practitioners quote head 1-4541-0000-2681). Renewal under r.20 is applied for at least thirty days before expiry, with the current certificate, the challan, the updated trade licence and, for Orange and Red, the environmental monitoring reports and ETP operation records the conditions require. A one-year Orange or Red certificate therefore means an application every ten months and a standing file of monitoring data; the units that fall foul of the DoE are rarely the ones without a certificate at all, they are the ones with an expired one and no ETP log.
Operating without, and what the DoE can do
Section 15 of the Act, as amended in 2010, sets the penalties. For establishing or operating without an ECC in breach of s.12: imprisonment of two to five years, a fine of Tk 1 lakh to Tk 5 lakh, or both. For failing to comply with a Director General’s order under s.7 to pay compensation or take corrective action: a first offence one to two years or Tk 50,000 to 2 lakh, a repeat two to ten years or Tk 2 to 10 lakh. Offences against the Rules themselves are capped at two years or Tk 2 lakh (s.15(2)). Expansion of a unit also needs clearance (s.12(3)), so adding a line under an existing certificate is the same offence. Beyond prosecution, the Rules give the DoE two administrative levers: it can require the utility providers to disconnect gas, electricity and water from an unlicensed unit (r.23), and it can suspend or cancel a certificate for unpaid compensation or breach of conditions (r.36). Mobile courts under the Act have fined and sealed dyeing units, brick kilns and real estate sites; the fines are usually small, the sealing is the cost. A sale or financing of the business will also stall: banks ask for the ECC in the credit file and buyers’ auditors in garments and leather list it as a critical document.
Practical sequence for a new unit
Before signing the lease or deed: check the colour with the divisional office and check the location against the master plan, because a Red site next to a canal will not get a location clearance at any price. After the trade licence and TIN: apply for the location clearance (Yellow and above) with the layout and the waste plan drawn properly, since the layout filed here is the one DIFE and the Fire Service will also see. Only then build, connect utilities and install. Before trial production: the ETP commissioned where required, the ECC applied for and issued. Every year after: the monitoring reports, the ETP log, the renewal thirty days before expiry, and the fresh clearance before any expansion. We prepare the file, brief the consultant on the IEE or EIA scope, attend the inspection and handle the conditions; our DIFE guide and fire licence guide cover the two licences that follow the same layout.

Common questions
Who needs an environmental clearance certificate in Bangladesh?
Every industrial unit or project (s.12 of the Environment Conservation Act 1995). The 2023 Rules sort activities into Green, Yellow, Orange and Red; only the paperwork and the validity differ.
What is the difference between a location clearance and an environmental clearance?
The location clearance comes first for Yellow, Orange and Red projects and must be in hand before construction or any utility connection (r.6(3)). The ECC comes after construction and before trial production (r.6(4)). Green projects need only the ECC.
How long is the environmental clearance valid?
Under r.20 of the 2023 Rules: five years for Green, two for Yellow, one for Orange and Red. Apply for renewal at least thirty days before expiry.
Which category is a garment factory?
Cutting and sewing without washing or dyeing is reported as Yellow; a unit with washing, dyeing or printing is Orange. Capacity can move the class, and the divisional DoE office fixes it.
Does a restaurant need an environmental clearance?
Yes. Hotels and restaurants are reported as Yellow: a location clearance first, then the ECC, valid two years.
What is the fee for the environmental clearance?
By category and investment slab under the schedule. The 2023 schedule was not readable at the date above; the 1997 schedule ran from Tk 1,500 to Tk 5,00,000 with renewal at one quarter, plus 15% VAT. Take the figure from the portal demand.
What is the penalty for operating without an ECC?
Section 15: two to five years' imprisonment, a fine of Tk 1 lakh to Tk 5 lakh, or both; utility disconnection under r.23; and the same offence for expanding without clearance (s.12(3)).
Do factories inside an EPZ or economic zone need a location clearance?
No. Under the proviso to r.6(1) units in an EPZ, economic zone or BSCIC estate need the ECC only, in their own colour, before trial production.
